Rules & Regulations

1. GENERAL

The YMC Visions of Motherhood 2017 Contest (the “Contest”) is operated by YummyMummyClub.ca (the “Sponsor”). By entering the contest, you (the “Entrant”) acknowledge that you are in compliance with these rules and regulations (the “Rules”) and agree to be bound by the Privacy Policy herein (see section 5).

2. HOW TO PARTICIPATE

2.1 Eligibility: The Contest is open to residents of Canada (excluding Quebec) who have reached the age of majority in their Province or Territory of residence. Persons in any of the following categories are NOT eligible to participate or win prizes in this Contest: (a) any person who, at any time on or after March 18, 2017, was or is a director, officer, employee, or agent of YummyMummyClub.ca or any of its prize suppliers, or any of their respective divisions, parent, subsidiary, or affiliated companies, franchisees, or service agencies, or independent contractors; and (b) any person who, at any time on or after March 18, 2017 was or is a director, officer, employee, or agent of any company involved with the administration of the contest or any individuals engaged in the development, production or distribution of materials for the Contest (collectively the “Contest Entities”); and (c) any person who is an immediate family member of, or domiciled with, any of the above.

2.2 Contest Period: The Contest begins at 12:00 pm, ET, September 25, 2017 and ends at 11:59, ET, October 25, 2017 (the “Contest Period”).

2.3 Contest Entry: No Purchase Necessary.  To enter the Contest, simply go to URL https://yummymummyclub.wufoo.eu/forms/mxv5gew02io8m1/(the “Website”) during the Contest Period and follow the on-screen instructions to obtain the Official Contest Entry Form (the “Entry Form”). Fully complete the Entry Form with all required information, your written entry and submit it by clicking the appropriate button, ensuring you first check the appropriate box indicating your compliance with these Rules (the “Entry/Entries”). To be eligible, your Entry must be submitted and received within the Contest Period.

2.4 Contest Entry Restrictions: Entrants are restricted to one (1) Entry per YMC Member per day. Each Entry must include a unique image the entrant has photographed themselves. For greater certainty, you can only use one (1) email address to enter the Contest. Entries indicating the same email address will be considered, for purposes of the Contest, to belong to the same Entrant and therefore are subject to the above restriction.  If it is discovered that any Entrant has attempted to: (i) obtain more than one (1) Entry (as defined above) during the Contest Period; and/or (ii) use (or attempt to use) multiple names, identities and/or more than one (1) email address to enter the Contest; then (in the sole and absolute discretion of the Sponsor) he/she may be disqualified from the Contest and all of his/her Entries voided. For greater certainty, use (or attempted use) of multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest is prohibited and is grounds for disqualification by the Sponsor. The Releasees (defined below) are not responsible for late, lost, misdirected, delayed incomplete or incompatible Entries (all of which are void). All Entries are subject to verification at any time. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s).

2.5 Submitted Materials: By entering this Contest, Entrants acknowledge that all Entries become the property of Sponsor and will not be returned or acknowledged. Entries must be between original works. When submitting Entries, Entrants will be required to submit a photograph of perspective inspired by the motherhood. 

Entries must be original and cannot have been submitted to any other contest up to the time the winners are declared on or around October 25, 2017. Once an Entry is received, no revisions will be allowed.

Entrants affirm, represent and/or warrant that (i) Entrants own or have the necessary licenses, rights, consents and permissions to use and authorize the Sponsor to use all copyright, trademark or other proprietary rights in and to the Entry to enable inclusion and use of the Entry in the manner contemplated by these Rules; and (ii) Entrants have the written consent, release and/or permission of each and every identifiable individual person in the Entry to use the name of each and every such identifiable individual person to enable inclusion and use of the Entry in the matter contemplated by these Rules. Sponsor reserves the right to reject and disqualify any Entry that could be offensive or inappropriate or that does not meet the terms and conditions of these Rules.

By participating, you warrant and represent that your photograph: (a) is original to you and that you have all necessary rights to the photograph to enter the contest; (b) does not violate any law, statute, ordinance or regulation; (c) will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims for payment whatsoever; (d) is not defamatory, trade libellous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following: nudity; explicit, graphic or excessive sexual activity; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual or religious groups; content that endorses, condones and/or discusses any illegal, inappropriate or risky activity, behaviour or conduct; personal information of individuals, including, without limitation, names and addresses (physical or electronic); conduct or other activities in violation of these Rules; commercial messages, comparisons or solicitations for products or services other than those of the Contest Sponsor; and any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole discretion.           

Any photograph that the Contest Sponsor deems, in its sole discretion, to violate the terms and conditions set forth in these Rules will be disqualified.

2.6 Publishing Materials: By entering the Contest, Entrants agree to allow the Sponsor to publish their Entry, name and biographical information in all media, including but not limited to YummyMummyClub.ca and/or other web sites without additional compensation. YummyMummyClub.ca reserves the right to edit and make necessary changes to Entries to fit with the websites’ style.

2.7 Ownership/Use Rights: Entrants retain the copyright to their written Entry. However, by entering the Contest, Entrants hereby grant the Sponsor a worldwide, irrevocable, perpetual, non-exclusive, royalty-free, sub-licensable and transferable license to print, publish, use, edit, reproduce, distribute, prepare derivative works of, and display Entrant’s full name, Entry photograph in connection with Sponsor’s (and its successor’s) business, including without limitation in any media formats and through any media channels, including social media. Entrants grant also permits having portions of their submission to be used by the Sponsor on their social media properties and also by any of their partner agencies. All Entrants agree to being contacted by the Sponsor for PR purposes if they are selected as the a winner and agree to participate in a short telephone interview to discuss their entry

3. WINNERS SELECTION PROCESS

3.1 Judging: Entries will be judged by a YummyMummyClub.ca judging panel (the “Judging Panel”) that will select the eight (8) winning Entries on or about October 25, 2017. Odds of winning depend on the number of eligible Entries received and the calibre of the Entries. Entries will be judged on originality and creativity and based on the following criteria:

Creativity
We are looking for originality and freshness in photographs. How does the photo visually express your imagination?

Composition
In judging composition, we will look at how you have used things like lines, shapes, colours, patterns, values, textures, form, balance, space (and negative space) within the frame of an image. How are all the visual elements brought together to express the intention of your image?

Technical Quality
The quality of the photographs will be assessed based upon details like lighting, colour, exposure and focus. We’re looking for top notch images.

Impact
We are searching for compelling images that evoke emotion—be it, laughter, poignancy, sadness, anger, love, wonder or any other another intense feeling relating to parenthood. What is that “wow” factor that makes the image impactful?

Storytelling
We are seeking photographs that share your point of view as a parent and as an image maker. What do we imagine is happening within your photograph? Tell us a story of your experience of parenthood through the lens of your camera.

Each entry will be scored equally on each of the above criteria to generate a total score. The entry with the highest total score will be selected Grand Prize winner. The next four highest scores will be selected as Secondary Winners. The next five highest scores will be selected as Runners Up Winners. In the event of a tie, the Entry with the highest score on inspirational quality will be determined to be the Winner. The decisions of the Judging Panel are final in respect of any matter relating to this Contest.

3.2 Notification of Selection: The winning Entrant will be contacted by telephone or email on or around October 25, 2017 by a representative of YummyMummyClub.ca and must reply within 48 hours to maintain eligibility. If the winner cannot be contacted within this time period or fails to respond to any attempted contact, such potential winner will be disqualified, his/her Entry will be declared null and void and the Sponsor reserves the right, in its sole and absolute discretion, to select another potential winner based on the next highest score on the judging criteria, in which event these provisions shall apply to such other eligible Entry. Upon the acceptance of the winner, the secondary winners will be contacted by telephone or email by a representative of YummyMummyClub.ca, and must reply within 48 hours to maintain eligibility. If the winners cannot be contacted within this time period or fails to respond to any attempted contact, such potential winner will be disqualified, his/her Entry will be declared null and void and the Sponsor reserves the right, in its sole and absolute discretion, to select another potential winner based on the next highest score on the judging criteria, in which event these provisions shall apply to such other eligible Entry. Upon the acceptance of the Secondary Winners, the Runners Up winners will be contacted by telephone or email by a representative of YummyMummyClub.ca, and must reply within 48 hours to maintain eligibility. If the winners cannot be contacted within this time period or fails to respond to any attempted contact, such potential winner will be disqualified, his/her Entry will be declared null and void and the Sponsor reserves the right, in its sole and absolute discretion, to select another potential winner based on the next highest score on the judging criteria, in which event these provisions shall apply to such other eligible Entry.

4. PRIZE

4.1 Prizes: The Contest will award 8 prizes:

 

One Grand Prize winner will receive a prize package worth over $1400 including a CANON EOS M5 BLACK W/EF-M 15-45MM IS LENS, as well as a print package (outlined below), generously donated by Henry's

All prints must be ordered in the same transaction. Valid In store only on the Henry’s Kodak Instant Print Kiosk. Not valid on line.

One First Runner Up: $500 

One Second Runner Up: $ 250

Five Third Place Winners shall each recieve $100  

Prizes must be accepted as awarded. No cash alternatives, substitution or transfers of the Prizes will be allowed. The Sponsor reserves the right to substitute a prize of equal or greater value, or the equivalent cash amount, in the event that the prize described is unavailable due to circumstances beyond their control.

5. GENERAL RULES

5.1 Each Prize claim is subject to verification by the Sponsor and/or its designated representatives. Entries made with multiple addresses, under multiple identities, or through the use of any device or artifice to enter multiple times or entries that are in excess of the permitted number of entries during the Contest Period are automatically void. All Contest entries become the property of YummyMummyClub.ca. All Contest entries obtained through unauthorized sources or which are incomplete, illegible, mutilated, altered, reproduced, forged, irregular or fraudulent in any way or otherwise not in compliance with these Rules are automatically void. If a dispute arises regarding who submitted an online entry, the entry will be deemed to be submitted by the authorized account holder of the email address provided at time of entry. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. The Sponsor will be the sole and final reference source in validating a Prize claim.

5.2 By participating, each Entrant and selected winning Entrant agrees: (a) to be bound by and always be in compliance with these Rules and the decisions of the Sponsor; (b) to release and hold harmless the Sponsor, or any of the Contest Entities, and their respective directors, officers, employees, agents, divisions, parents, subsidiaries, affiliated companies, franchisees, service agencies, or independent contractors, from any and all liability for claims/damages in connection with their participation in this Contest or the acceptance of any Prize, including but not limited to claims/damages for personal injury or for loss or property damage with respect to acceptance, possession or use or misuse of the Prize; (c) to permit the Sponsor or any of the Contest Entities to use the name, city and/or province of residence, photograph, video, or any likeness of the winning Entrant(s) for advertising or publicity purposes without any additional compensation; (d) to accept the Prize(s) as awarded; and (e) the winning Entrant(s) agrees to complete a Declaration and Release Form to this effect.

5.3 The decisions of the Sponsor in relation to this Contest will be final and binding on all Entrants.

5.4 The Sponsor or any of the Contest Entities shall not be responsible for incorrect or inaccurate transcription or registration of Contest entry information, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, faulty, incomplete, incomprehensible, or erased computer or network transmissions, line failures of any telephone network, failure of computer equipment, software, inability to access any online service or web site, inability to submit the online survey, or any other error or malfunction, or any injury or damage to Entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Contest.

5.5 The Sponsor reserves the right to cancel, terminate, or suspend this Contest, at its sole discretion, in the event of a technical failure, computer virus or bug, unauthorized human intervention, fraud or any other occurrence or cause beyond its control that corrupts or adversely affects the administration, security, fairness or normal operation of the Contest. In the event of early termination of the contest, a notice will be posted online and a random drawing to award all prizes will be conducted from among all eligible entries received prior to the time of termination or no prizes shall be awarded. The Sponsor reserves the right to modify this contest or disqualify Entrant if fraud, misconduct or technical failures destroy the integrity of the contest as determined by the Sponsor, at its sole discretion.

5.6 If a selected Entrant is awarded the Prize due to a system error, malfunction or defect the Prize will be returned to the Prize pool, to be re-awarded.

5.7 Under no circumstances will the Sponsor or any of the Contest Entities, or their respective directors, officers, employees, agents, divisions, parents, subsidiaries, affiliated companies, franchisees, service agencies, or independent contractors be required to award more Prizes than what is indicated in these Rules or award the Prizes other than in accordance with these Rules.

5.8 The Contest is subject to all Federal, Provincial and local laws, as well as the rules adopted in view of said laws. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of Entrant and the Sponsor and / or the Contest Entities in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to Ontario conflicts of law principles. All Entrants consent to submit any dispute arising from these Rules to the exclusive jurisdiction and venue of the Courts of the Province of Ontario, region of Toronto.

6. PRIVACY POLICY

6.1 The Sponsor and / or the Contest Entities warrant that it will only use the personal information collected through the Contest as per this Privacy Policy, and will treat all personal information with the utmost care.

6.2 By entering the Contest, you agree to the use of your personal information as described in this Privacy Policy. The personal information collected about you is limited to the information you have voluntarily supplied through the Contest entry page.

6.3 Except as provided herein, the Sponsor and / or the Contest Entities will not divulge any personal information gathered through the Contest to third parties. Moreover, the Sponsor and/or the Contest Entities will not sell any personal information collected.

6.4 The personal information collected will only be used for the following purposes: (i) use of the winning Entrants’ information as described in section 4.2 above; (ii) administration of the Contest on an as needed basis; (iii) further communications from the Sponsor where the Entrant has voluntarily agreed to receive such communications by checking the box to that effect on the Contest entry page.

6.5 Notwithstanding anything in this Privacy Policy to the contrary, we may share any information we have collected about you: (i) in response to subpoenas, court orders, or legal process, or to establish, protect, or exercise our legal rights or defend against legal claims or demands; (ii) if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, fraud, or situations involving potential threats to the safety of any person; (iii) if we believe it is necessary to investigate, prevent, or take action regarding situations that involve abuse of the website infrastructure or the Internet in general; (iv) to a parent company, subsidiaries, joint ventures, or other companies under common control with the Sponsor and / or the Contest Entities (in which case we will require such entities to honour this Privacy Policy); and (v) if the Sponsor and / or the Contest Entities is acquired by or merged with another entity (in which case we will require such entity to assume the obligations under this Privacy Policy).

6.6 Despite efforts to ensure third parties will not access or obtain your personal information, complete confidentiality and security cannot currently be guaranteed on the Internet. Communication via the Internet is subject to interception, loss, or alteration. You acknowledge and agree that the Sponsor and/or the Contest Entities or their respective directors, officers, employees, agents, divisions, parents, subsidiaries, affiliated companies, franchisees, service agencies, or independent contractors cannot be held responsible for damages resulting from the transmission of confidential information or personal information over the Internet and that such communications are at your own risk.
