Motorist Sues Teen She Struck and Killed

Litigation gone mad?

motorist suing teen

The story of a woman who struck and killed a 17-year-old cyclist with her SUV has to be the ultimate in adding insult to injury.

According to an article in Canoe, Brandon Majewski's family was still grieving when they discovered their dead son was being sued—by the driver.

The fatal accident took place 18 months ago in Innisfil, Ont., when Sharlene Simon ploughed into Majewski and three friends, one of whom suffered serious injuries.

Now, incredibly, 26-year-old Simon is suing all three families—including the deceased Majewski—for $1.35-million to compensate the pain and suffering which has curtailed her "enjoyment of life." We can't even.

“She killed my child and now she wants to profit from it?" said Brandon's father, Derek Majewski. "She says she’s in pain? Tell her to look inside my head and she will see pain, she will see panic, she will see nightmares.”

Due to poor visibility on the road, there is no prospect of convicting Simon, whose lawsuit also targets the County of Simcoe for failing to adequately maintain the road.

Simon also claims the boys were negligent, for failing to apply their brakes properly.

The case makes for a disturbing precedent, which the Majewski's lawyer claims goes beyond the pale.

This famous lawsuit also left us speechless.
